The Mutual Termination agreements, ECF No. 231 -1, Page ID 3197-3215, executed by A CI and its Affiliates did not eliminate ACI's obligations, or Churchill's rights, under the post-termination royalty provision of § 9.3 of the License Agreement. b. Churchill is entitled to partial summary judgment on its breach of con tract claim in the amount of $967,736.02, exclusive of interest, for royalties due under the License Agreement prior to its termination. The Motion for Partial Summary Judgment is otherwise denied. The Motions to Exclude Opinion Testimony, ECF Nos. 234 & 237 , filed by Plaintiff ACI Worldwide Corp., are denied. March 23, 2018 Opinion or Order Filing 190 ORDER - IT IS ORDERED: ACI shall produce the master agreements with attachments responsive to Request for Production No. 82 on or before March 30, 2018. ACI shall complete its supplemental rolling production of documents responsive to the remaining Requests for Production, as discussed during the telephone conference and set forth above, on or before April 13, 2018. The parties shall file an updated joint status report regarding ACI's production of documents by April 27, 2018. The parties shall contact the undersigned magistrate judge's chambers after preparing the joint status report to schedule a telephone conference to discuss any outstanding discovery disputes. Churchill's Motion to Compel Post-Termination Royalty Discov ery (Filing No. 135 ) is denied without prejudice to reassertion after it reviews ACI's supplemental production and after the telephone conference in paragraph 4 is held. Additional briefing on issues previously raised and addressed in briefing on the Motion to Compel will not be permitted without leave of Court. Motions concerning discovery disputes shall not be filed without first contacting the chambers of the undersigned magistrate judge to set a conference to discuss the parties dispute. May 2, 2017 Opinion or Order Filing 120 ORDER - Churchill shall file a supplemental brief in opposition to ACI's Motion to Amend Complaint on or before May 16, 2017. ACI shall file a response, if any, on or before May 26, 2017. In the event that Churchill determines a reply is necessa ry, it shall file one on or before June 5, 2017. All pending discovery motions (Filing Nos. 64 , 87 , and 104 ) which were held in abeyance by the Court by its Order dated December 30, 2015, will continue to be held in abeyance pending the Court&# 039;s decision on ACI's Motion to Amend Complaint 81 . Within five days of the Court's ruling on ACI's Motion to Amend Complaint, counsel for the parties shall confer regarding the outstanding discovery motions and whether said motion s are to be abandoned in whole or in part, whether they are to be treated as fully submitted, or whether further briefing is necessary. Within ten days of the Court's ruling on ACI's Motion to Amend Complaint, counsel for the parties shall submit a proposed progression order for any remaining discovery and final disposition of the case. ACI's Motion in Limine (Filing No. 96 ) is moot and shall be deemed abandoned by ACI for the reason that Churchill has indicated it does not intend to call Mr. Clyde as an expert witness at trial. December 30, 2015 Opinion or Order Filing 107 ORDER that plaintiff's Motion for Leave to File a Supplemental Brief in Connection with its Pending Summary Judgment Motion 103 is granted. Plaintiff shall file its Supplemental Brief no later than December 31, 2015. Plaintiff has informed th e Court that its Motion for Summary Judgment is ripe for adjudication, 102 . Therefore, the Court will not address Plaintiff's Motion to Amend Complaint 81 at this time. All discovery motions now pending in this case 64 , 87 , and 104 wil l be held in abeyance pending rulings on Plaintiff's Motion for Summary Judgment 58 and Defendant's Motion for Partial Summary Judgment 30 .
