Filing 33 ORDER - At the defendant's request, the court scheduled a telephonic hearing to discuss scheduling the plaintiff's deposition. (Filing No. 28 ). The pro se plaintiff then moved for appointment of counsel. (Filing No. 29 ).1) Plaintiff 's motion for appointed counsel, (Filing No. 29 ), is denied.2) Plaintiff's oral motion to recuse and for appointment of a different judge, (Filing No. 32 ), is denied. 3) Plaintiff shall cooperate with scheduling her deposition, and shall make herself available to be deposed by the defendant by no later than January 4, 2016. Plaintiff is hereby notified that her failure to cooperate with scheduling her deposition, attend a noticed deposition, or appropriately respond to deposition questioning may result in dismissal of this lawsuit for want of prosecution, or as a discovery sanction, without further notice. Filing 8 MEMORANDUM AND ORDER - The clerk of the court is directed to send to Temple a copy of the Complaint, a copy of this Memorandum and Order, and two summons forms and two USM 285 Forms. Federal Rule of Civil Procedure 4(m) requires service of the compl aint on a defendant within 120 days of filing the complaint. However, Temple is granted, on the court's own motion, an extension of time until 120 days from the date of this order to complete service of process. If requested to do so in this matter, the United States Marshal will serve all process in this case without prepayment of fees from Temple. In making such a request, Temple must complete the USM 285 forms to be submitted to the clerk of the court with the completed summons fo rms. Without these documents, the United States Marshal will not serve process. Upon receipt of the completed forms, the clerk of the court will sign the summons forms and forward them to the Marshal for service on Defendant, together with a copy o f the Complaint. The clerk of the court is directed to set a pro se case management deadline in this case with the following text: June 23, 2015: Check for completion of service of summons. Filing 6 MEMORANDUM AND ORDER- Temple will have 30 days from the date of this Memorandum and Order to notify the court in writing of the date on which she received a right-to- sue notice in response to her charge of discrimination dated November 13, 2013 (se e Filing No. 1 at CM/ECF p. 9). To the extent Temple did not file suit within 90 days of her receipt of the right-to-sue notice, she must show that equitable or exceptional circumstances exist that warrant tolling of the 90-day period. Temple w ill have 30 days from the date of this Memorandum and Order to notify the court in writing of the date on which she received a right-to- sue notice in response to her charge of discrimination dated February 10, 2014 (see id. at CM/ECF p. 8). To the extent Temple did not file suit within 90 days of her receipt of the right-to-sue notice, she must show that equitable or exceptional circumstances exist that warrant tolling of the 90-day period.
