February 2, 2023 Opinion or Order Filing 8 DECISION AND ORDER: ORDERED that #6 Motion for Leave to Proceed in forma pauperis is granted. ORDERED that all claims for monetary damages against the defendants in their official capacities are DISMISSED with prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) as barred by the Eleventh Amendment. ORDERED that the following claims SURVIVE sua sponte review and require a response: (1) plaintiff's First Amendment free exercise claim against defendant Bombard; (2) plaintiff's Eighth Amendment excessive force and failure-to-intervene claims against defendants Bombard, John Doe, and Cymbrak; (3) plaintiff's Eighth Amendment medical indifference claims against defendants Bombard, John Doe, and Cymbrak; and (4) plaintiff's Fourteenth Amendment equal protection claim against defendant Bombard. ORDERED that all remaining claims are DISMISSED without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) for failure to state a claim upon which relief may be granted. ORDERED that the Clerk shall TERMINATE Superintendent McIntosh as a defendant. ORDERED that the Clerk shall issue summonses and forward them, along with copies of the complaint, to the United States Marshal for service upon defendants Bombard and Cymbrak. The Clerk shall forward a copy of the summons and complaint to the Office of the New York State Attorney General, together with a copy of this Decision and Order, by electronic mail only. ORDERED that a response to the complaint be filed by defendants Bombard andCymbrak, or their counsel, as provided for in the Federal Rules of Civil Procedure. ORDERED that plaintiff take reasonable steps to ascertain the identity of the "Doe" defendant, and when identified, seek to amend the complaint to add this individual as defendant in this action pursuant to Federal Rule of Civil Procedure 15(a).
