Filing 4 ORDER AND REPORT AND RECOMMENDATION re #3 Complaint filed by Dinell Maurice Copeland. It is Therefore recommended that: 1. The complaint be DISMISSED with prejudice against Defendant, Butler County Jail, pursuant to 28 U.S.C. 1915(e)(2)(B) and 1915A(b)(1). 2. The Court certify pursuant to 28 U.S.C. 1915(a)(3) that for the foregoing reasons an appeal of any Order adopting this Report and Recommendation would not be taken in good faith, and therefore, deny plaintiff leave to appeal in forma pauperis. See McGore v. Wrigglesworth, 114 F.3d 601 (6th Cir. 1997). It is Therefore Ordered that: 1. Plaintiff shall be permitted to proceed with his Eighth Amendment excessive force claim against Defendant, Brendan Kelly, in his individual capacity. 2. Plaintiff, within thirty (30) days of the date of this Order, submit a completed summons and U.S. Marshal form for service on Defendant, Brendan Kelly. Once the Court receives the summons and United States Marshal forms, the Court will order service of process by the United States Marshal. Objections to R&R due by 5/16/2022.
