Date Filed Document Text
January 15, 2010 Opinion or Order Filing 43 DECISION AND ORDER ON MOTION FOR SUMMARY JUDGMENT - Defendant Henson's Motion for Summary Judgment is granted. Based on that decision, the Court finds Defendant Plummer is entitled to judgment as a matter of law. The Clerk will accordingly enter judgment dismissing the Complaint with prejudice. Signed by Magistrate Judge Michael R Merz on 1/15/2010. (kpf1)
September 9, 2009 Opinion or Order Filing 33 NOTICE TO COUNSEL - This case is before the Court on Plaintiff's Motion to Dismiss Butler Township Police Department (Doc. No. 32). Plaintiff desires to dismiss without prejudice; Butler Township will consent to dismissal only with prejudice. I t is the Court's understanding that a dismissal without prejudice of the case against Butler Township would leave these two parties as if nothing had been done, no suit had been filed. The Court further understands that the two-year statute of limitations for claims under § 1983 has expired and this claim would not be saved by the Ohio savings statute, Ohio Revised Code § 2305.19. Therefore a dismissal without prejudice may leave the claim barred by the statute of limitations. Counsel should by their own research satisfy themselves whether the Court's understanding is correct. If it is, the parties may wish to reconsider their positions on the Motion. Signed by Magistrate Judge Michael R Merz on 9/9/2009. (kopf1, )
August 27, 2009 Opinion or Order Filing 26 DECISION AND ORDER GRANTING MOTION TO BIFURCATE - Defendants' Motion to Bifurcate is GRANTED. Signed by Magistrate Judge Michael R Merz on 8/27/2009. (kopf1, )
July 6, 2009 Opinion or Order Filing 17 MINUTE ENTRY - This case came on for a telephone conference on outstanding discovery issues at 1:30 p.m. on July 6, 2009. While a number of different issues which may have an impact on scheduling and/or may require additional orders from the Court w ere discussed, the only matter presently requiring an order is Plaintiff's production of documents requested by Ms. Dinkler and not yet produced. All such documents will be produced to her not later than July 20, 2009. Signed by Magistrate Judge Michael R Merz on 7/6/2009. (kopf1, )
