The parties' Stipulation To Award EAJA Fees (Doc. # 19 ) is accepted, and the Commissioner shall pay Plaintiffs attorney fees under 28 U.S.C. §2412 in the total amount of &# 036;2,894.06. 2. Defendant shall verify, within thirty days of this Decision and Order, whether or not Plaintiff owes a pre-existing debt to the United States subject to offset. If no such pre-existing debt exists, Defendant shall pay the EAJA award directly to Plaintiff; and 3. The case remains terminated on the docket of this Court. January 8, 2013 Opinion or Order Filing 13 REPORT AND RECOMMENDATIONS IT IS THEREFORE RECOMMENDED THAT: 1. The Commissioner's non-disability finding be vacated. 2. The case be remanded to the Social Security Administration for the purpose of awarding Disability Insurance Benefits to Plaintiff Paul R. Poppel for the period beginning on June 10, 2005 and ending on February 8, 2009 consistent with the Social Security Act. 3. No finding be made as to whether Plaintiff Paul R. Poppel was under a "disability" within the mea ning of the Social Security Act beginning on February 9, 2009 and this case be remanded to the Social SecurityAdministration under Sentence Four of 42 U.S.C. §405(g) for further consideration consistent with this Report. 4.
