August 22, 2013 Opinion or Order Filing 2 ORDER GRANTING IN FORMA PAUPERIS STATUS; REPORT AND RECOMMENDATIONS - The Court sua sponte grants Petitioner permission to proceed in forma pauperis. Because Ulrich did not appeal from the final decision of the court of appeals to the Ohio Supreme C ourt, he has procedurally defaulted on his claims and they are barred from merit consideration in this Court. The Petition should therefore be dismissed with prejudice. Because reasonable jurists would not disagree with this conclusion, Petitioner should be denied a certificate of appealability and the Court should certify to the Sixth Circuit that any appeal would be objectively frivolous. Objections to R&R due by 9/9/2013. Signed by Magistrate Judge Michael R Merz on 8/22/2013. (kpf1)
