For these reasons, the Court GRANTS the Motion (#37) to Dismiss filed by Nominal Defendant Apex Drive Laboratories, Inc.; GRANTS the Motion (#39) to Dismiss or in the Alternative for Summary Judgment filed by Defenda nts Baker Group LLP and Michael J. Baker; GRANTS the Motion (#44) to Dismiss or in the Alternative for Summary Judgment filed by defendants Altman Browning and Company, Kay E. Altman, and David M. Browning; and DENIES the Motion (#58) for Leave to Fi le (Third) Amended Complaint filed by Plaintiff Quantum Technology Partners II, L.P. The Court DENIES in part and GRANTS in part Quantum's Motion to File (Third) Amended Complaint to the extent that Quantum has leave to file no later than July 7 , 2009, a Third Amended Complaint limited to a putative claim for breach of contract asset out by Quantum in its Motion for Leave to File Third Amended Complaint.
