It is therefore ORDERED that the Respondent's motion for summary judgment, docket number 9 , is grant ed, and Harmon's § 2254 petition, docket number 1 , is denied. It is further ORDERED that a certificate of appealability is denied because Harmon has failed to make "a substantial showing of the denial of a constitutional right." 28 U.S.C. § 2253(c)(2).
