July 3, 2012 Opinion or Order Filing 137 MEMORANDUM OPINION AND ORDER The court finds that Ohio law provides the applicable rule of decision in this case and the plaintiffs cannot recover costs and attorney fees under Hayseeds, Inc. vs. State Farm Fire & Cas. 352S.E.2d 73 (W. Va. 1986). In light of this ruling the Court orders the parties to submit, no later than Thursday July 5, 2012, a revised joint statement identifying each party's position with regard to the proper allocation of all remaining questions as between the Court a nd the jury. The revised statement will identify any changes to the Pretrial Order in light of this ruling. The Court will hold a telephone conference on Friday, July 6, 2012, at 10:30 am, to discusss the issues identified in the revised statement.
