MEMORANDUM OPINION AND ORDER granting in part and denying in part Plaintiff CPA's 15 Motion to Dismiss for Failure to State a Claim; CPA's motion to dismiss Count VI of the counterclaims is granted only to the extent that Count VI allege s a claim for relief based on tortious interference with independent testing laboratories; Count VI of the counterclaims may proceed, however, as to the alleged tortious interference with Canalta clients; CPA's motion to dismiss Counts II and V of the counterclaims is DENIED; denying Defendant Dale Sawchuk's 25 MOTION to Dismiss for lack of personal jurisdiction and finding that its exercise of personal jurisdiction over Mr. Sawchuk is proper.
