MEMORANDUM OPINION After careful consideration of the evidence of record, the Court finds that the Commissioner's decision is based upon an incorrect application of the law; therefore, by Judgment Order entered this day, the final decision of the Commissioner is Reversed and this matter is Remanded for further proceedings consistent with this opinion.
