MEMORANDUM OPINION AND ORDER: Wherefore, after careful consideration, the court ORDERS that the Magistrate Judge's 39 Proposed Findings and Recommendation be ADOPTED, and that the objections contained in the Plaintiff's 41 Motion in O pposition be OVERRULED. The Court further ORDERS that the Defendant's 25 Motion to Dismiss, or in the Alternative, Motion for Summary Judgment be GRANTED, and that the Plaintiff's Complaint, as amended by his 6 Amended Motion, be DISMISSED.
