Before requiring a full answer from Respondents, the Court finds it would be beneficial to obtain a response from the State addressing (1) whether a federal habeas corpus petition is a proper vehicle for a state prisoner to seek compassionate release to home confinement based on COVID-19, or (2) whether Williams's claims concerning his conditions of confinement based on COVID-19 are more appropriately brought in a 42 U.S.C. 1983 civil rights complaint. Accordingly, it is ORDERED that by 1/8/2021, the Attorney General for the State of AL shall file response addressing these questions regarding the proper federal remedy for Williams's claims.
