ORDER: Before the Court is Willie Kevin Williams's self-styled "Motion for Emergency Relief under 28 U.S.C. 2254 due to COVID-19 Pandemic." (Doc. #1 .) Before requiring a full answer from Respondents, the Court finds it would be beneficial to obtain a response from the State addressing (1) whether a federal habeas corpus petition is a proper vehicle for a state prisoner to seek compassionate release to home confinement based on COVID-19, or (2) whether Williams's claims concerning his conditions of confinement based on COVID-19 are more appropriately brought in a 42 U.S.C. 1983 civil rights complaint. Accordingly, it is ORDERED that by 1/8/2021, the Attorney General for the State of AL shall file response addressing these questions regarding the proper federal remedy for Williams's claims. The Clerk is DIRECTED to send a copy of Williams's petition and this order to the Attorney General of the State of AL. Signed by Honorable Judge Charles S. Coody on 12/17/2020.
