ORDER granting in part 17 Motion to Deposit Funds and 17 Motion to Dismiss Party. Prudential is directed to deposit with the Circuit Clerk of Independence County, Arkansas (case no. CV-2010-324-4), a check in the amount of $96,550.00, less agreed upon attorneys' fees and costs in the amount of $3,450.00, which shall be retained by Prudential, plus claim interest, if any. Prudential will be discharged from any and all liability to the Adverse Claimants upon deposit of the Deposited Funds. The parties shall, within 10 days after the deposit of the Deposited Funds, file an executed Stipulation of Dismissal with this Court seeking dismissal of this matter with prejudice.
