Petitioner Paul Tovar began this case by filing a petition for writ of habeas corpus pursuant to 28 U.S.C. 2241. Respondent C. Garrett has now filed a response to the petition. In the response, Garrett maintains that the petition should be dismissed for two reasons: (1) the decision of the Discipline Hearing Officer is supported by some evidence, and (2) Tovar has failed to show that the Discipline Hearing Officer was biased. Before giving serious consideration to Garretts assertions, the Court accords Tovar an opportunity to file a reply. In the reply, Tovar should explain why his petition should not be dismissed for the reasons given by Garrett. Tovar is given up to, and including, September 25, 2023, to file a reply.
