Litigants in civil cases do not have an automatic right to appointed counsel. Phillips v. Jasper County Jail, 437 F.3d 791, 794 (8th Cir. 2006). Courts sometimes appoint lawyers in cases where the nature of the litigation is such that plaintiff as well as the court will benefit from the assistance of counsel. Johnson v. Williams, 788 F.2d 1319, 1322 (8th Cir. 1986). The decision to appoint counsel is based on the circumstances of each case. Filing 6 ORDER granting #1 Motion for Leave to Proceed in forma pauperis. However, the complaint will not be served on Defendants at this time, since the allegations in the complaint are not clear. By 5 p.m., Monday, August 1, 2022, Plaintiff must file a motion for leave to file an amended complaint. The proposed amended complaint must specifically: (1) identify the parties responsible for his alleged injury; (2) state how each individual Defendant was personally involved; and (3) explain the injury he suffered as a result of each Defendants conduct. Additionally, an amended complaint, if filed, will supersede or replace the current complaint. Plaintiff should make sure that his amended complaint includes all allegations relevant to the claim(s) he wants to pursue in this lawsuit. Finally, Plaintiff need only include a short and plain statement showing that he is entitled to relief, with allegations that are simple, concise, and direct. FED. R. CIV. P. 8(a)(1)& (d).
