ORDER granting #4 motion to proceed IFP. The Court will assess an initial partial filing fee of $123.11. Plaintiff's custodians are instructed to immediately collect the initial partial payment and forward that amount along with future monthly payments from plaintiff's prison trust account to the Clerk of Court until the entire $350 filing fee is paid. The Clerk of the Court is directed to send a copy of this Order to the Warden of the Greene County Detention Facility. #5 Motion to amend complaint is granted. The Clerk is instructed to file Mr. Malone's #5 motion as his second amended complaint and to add Jamie Floyd as a party Defendant. The Clerk is directed to prepare summonses for Defendants Robert Case, Steve Franks, Dane Barnum, Bailey Burns, Jasmine Sanchez, and Jamie Floyd. The U.S. Marshal is directed to serve the defendants with a summons, copy of the #1 complaint, #3 amended complaint, and #7 Second Amended Complaint without requiring prepayment of fees and costs or security.
