The Court approves and certifies unconditionally the following agreed group of similarly situated people for settlement of the group members' FLSA claims only:Former serve rs classified as hourly and non-exempt employees and employed by R J Tao at "Oishi" in Little Rock, Arkansas between September 15, 2014 through October 15, 2015 who consent to join this lawsuit. ORDER granting as modified 49 & 51 Joint Motion to approve proposed settlement agreement and related papers. The proposed deal (with one change) is fair, reasonable, and adequate. The change: The Court does not approve Article 7 on confidentialit y, and it is severed from the agreement, which the proposal allows to be done with unenforceable terms. The Court will have the Clerk file the lawyers' bill as part of the record under seal, 38 . ORDER: The Court held a hearing today on the joint motion to approve the proposed settlement agreement. At the hearing, the Court expressed its concerns about the proposed settlement's confidentiality provisions and the mixing of collective and class action claims in the settlement process for non-parties.
