Ivory's verbal harassment claim and excessive force claim against defendant Frasure are dismissed with out prejudice. In addition, Mr. Ivory's due process claim against defendant Middleton is dismissed without prejudice, and the Clerk is instructed to terminate defendant Middleton as a party defendant.
