PROPOSED FINDINGS AND RECOMMENDATIONS that Plaintiff's official damages capacity claims be dismissed with prejudice. Plaintiff's claims for injunctive relief be dismissed with prejudice. Plaintiff's failure to protect claims be dismissed without prejudice for failure to state a claim on which relief may be granted. Plaintiff's equal protection claims be dismissed without prejudice for failure to state a claim on which relief may be granted. Plaintiff's deliberate indifference to medical needs claims be dismissed without prejudice as improperly joined in this case. Plaintiff's violation of prison policy claims be dismissed without prejudice. Plaintiff's access to the courts claims be dismissed without prejudice. Defendants Denese Voss, Gordon, UAMS Angels, Reemes, and Wachuka be dismissed from this action. The Court has considered Plaintiff's need for an attorney, the likelihood that Plaintiff will benefit from assistance of counsel, the factual complexity of the case, the Plaintiff's ability to investigate and present her case, and the complexity of the legal issues. In considering these factors, the Court finds that Plaintiffs claims do not appear legally or factually complex, and it appears she is capable of prosecuting her claims without appointed counsel.
