PROPOSED FINDINGS AND RECOMMENDATIONS that Plaintiff be allowed to proceed with his failure to protect claim against Defendant Velazquez in his personal capacity only. All other claims be dismissed without prejudice for failure to state a claim upon which relief may be granted. Defendant Jefferson County be dismissed without prejudice because Plaintff has not pled a plausible claim against it. Defendant Brassell Detention Center be dismissed with prejudice because it is not an entity that can be sued in a 1983 action. The Court certify, pursuant to 28 U.S.C. 1915(a)(3), that an in forma pauperis appeal from an order adopting these recommendations would not be taken in good faith.
