June 9, 2020 Opinion or Order Filing 18 ** TEXT ONLY ORDER ** The parties have submitted what they call a stipulated motion to dismiss certain claims in plaintiff Steven Larson's complaint and to dismiss as moot defendant Wright Medical Technology, Inc.'s motion to dismiss. Dkt. #17 . But a stipulation under Rule 41(a) can be used only to dismiss the entire action; the appropriate vehicle to dismiss individual claims is an amended pleading under Rule 15(a). See Taylor v. Brown, 787 F. 3d 851, 857-58 (7th Cir. 2015). So I will construe the stipulation as a motion to amend Larson's complaint with Wright's written consent under Rule 15(a)(2), which is GRANTED. Wright's motion to dismiss, Dkt. #15 , is DISMISSED as moot. Signed by District Judge James D. Peterson on 6/9/2020. (voc) [Transferred from wiwd on 8/19/2020.]
