June 24, 2022 Opinion or Order Filing 8 (This is a TEXT ENTRY ONLY. There is no pdf document associated with this entry.) ORDER denying #4 Motion to Dismiss. This federal court is not going to second-guess a state court's determination that good cause existed for one or more extensions of the service period. The federalism concerns attendant to such second-guessing make this case a far cry from the Wilkins case. In any event, there is not enough to persuade me that there was fraud on the state court. One additional point bears mentioning. In footnote 2 of its brief, the Defendant states that "[t]o date, Plaintiff has not effectively served Fannie Mae. A process server emailed Fannie Mae a copy of the complaint and the summons on April 11, 2022. Email is not effective service under Arkansas Rule of Civil Procedure 4." This argument was not sufficiently developed for me to rule on it as part of the instant Motion to Dismiss. Signed by Judge Lee P. Rudofsky on 06/24/2022. (mwr)
