PARTIAL RECOMMENDED DISPOSITION that Plaintiff be allowed to proceed with his excessive force claim against Defendant Graef in his individual capacity only. All other claims against Defendant Graef be dismissed without prejudice for failing to state a claim upon which relief may be granted. The Dallas County Detention Center be dismissed with prejudice because it is not a proper party. The Court certify, pursuant to 28 U.S.C. 1915(a)(3), that an in forma pauperis appeal from an order adopting this recommendation would not be taken in good faith.
