REPORT AND RECOMMENDATIONS that defts' motion for summary judgment be granted and pltf's complt be dismissed with prejudice with respect to his claims regarding the allegedly false disciplinary charge, and failure to follow prison policy, a nd pltf's complt be dismissed without prejudice in all other respects 10 . The Court certify that an ifp appeal taken from the order and judgment dismissing this action is considered frivolous and not in good faith.
