ORDER ADOPTING 5 Report and Recommendations of Magistrate Judge. Plaintiff's 1 Motion for Leave to Proceed in forma pauperis is DENIED. Should he wish to continue this case, he must submit the $400 filing fee and a motion to reopen th e case within 10 days of this Order. Upon receipt of the motion and full payment, the case will be reopened. Plaintiff's 2 Complaint is DISMISSED without prejudice, and his 4 Motion to Appoint Counsel is DENIED as moot.
