Filing 88 ORDER OF DISMISSAL that the complaint and all claims in this action against defendants be, and they are, hereby dismissed with prejudice. The Court retains complete jurisdiction for 30 days to vacate this order and to reopen the action if it is satisfactorily shown that settlement has not been completed and further litigation is necessary. Signed by Judge J. Leon Holmes on 8/30/2019. (ljb) |
Filing 66 OPINION AND ORDER granting in part and denying in part 28 and 55 motions for summary judgment and motion for judgment on the pleadings; and denying 45 motion to strike. Sharon Silverman's claims under Title VII against Donna Stone in her i ndividual capacity are dismissed. All of Silverman's claims that her employment was terminated because of her race and her claims that she was subject to a hostile work environment because of her race are dismissed. Silverman's claim of int entional infliction of emotional distress is dismissed. The issue to be tried is whether Silverman was terminated in retaliation for complaining of race discrimination. As to Stone and Trinity Village, that claim survives under section 1981 and the Arkansas Civil Rights Act. As to Trinity Village, that claim also survives under Title VII and as a claim for wrongful discharge in violation of the employment contract. Signed by Judge J. Leon Holmes on 7/3/2019. (ljb) |
