January 4, 2018 Opinion or Order Filing 32 ORDER that the 31 Report and Recommendation is proper and should be and hereby is ADOPTED IN ITS ENTIRETY. Accordingly, for the reasons stated in the Magistrate Judge's Report and Recommendation, Defendants' Motion for Summary Judgment Doc. 23 is GRANTED IN PART and DENIED IN PART. Specifically, all claims against Sergeant Byrd and all personal capacity claims against Sheriff Helder are DISMISSED WITH PREJUDICE. In all other respects, the Motion is DENIED.
