Plaintiff states in his Motion that he believes he has only 14 days from the date of the Court's order dismissing the case to file a notice of appeal. This is incorrect. According to Federal Rule of Appellate Procedure 4(a)(4)(A)(vi), if a party files a motion for relief from judgment under Federal Rule of Civil Procedure 60, "the time to file an appeal runs... from the entry of the order disposing of the... motion." Here, Plaintiff filed a timely Rule 60 motion #14 , and the Court denied it in a text-only order 16 issued today, December 7, 2023. Therefore, Plaintiff's time to appeal starts today, December 7. He has 30 days from today to file his appeal, per Federal Rule of Appellate Procedure 4(a)(1)(A). Therefore, his request for an additional 30 days from today to file his notice of appeal is MOOT.
