Patterson and Kirkland state that their attorney-client agreement clearly provides that [they] will not represent [the] client in appeal after trial. Id. at 1. Defendants filed a statement of non-opposition. ECF No. 76. Plaintiff filed both a motion for appointment of counsel, ECF No. 71, and a motion to proceed in forma pauperis. The Court GRANTS Patterson and Kirklands motion to withdraw. Because Plaintiffs case is on appeal, this Court declines to place any restrictions on his timeline for retaining new counsel.
