Filing 16 ORDER denying #7 Motion for Appointment of Counsel. Plaintiff seeks appointment of pro bono counsel in this action. "[T]here is no constitutional right to appointment of counsel for litigants in civil cases[.]" Parks v. Smith, 505 F. App'x 42, 43 (2d Cir. 2012). Nonetheless, the Court has discretion to appoint an attorney to represent a self-represented litigant when he is "unable to afford counsel." 28 U.S.C. 1915(e); see also Parks, 505 F. App'x at 42. "[I]t is clear that the statute only allows appointment where a litigant is indigent." Sears, Roebuck & Co. v. Charles W. Sears Real Est., Inc., 865 F.2d 22, 23 (2d Cir. 1988).Plaintiff's Trust Account Statement indicates that he has a spendable amount of $11,570.55. See Doc. #3 at 2. In the six months preceding November 15, 2021, plaintiff's average account balance was been $12,571.79. See Doc. #2 at 5. Plaintiff has not shown that he is unable to afford counsel.
