Filing 15 ORDER granting #3 Motion for Leave to Proceed in forma pauperis; adopting #13 Recommended Ruling. The Court has reviewed Magistrate Judge Spector's Recommended Ruling in which he recommends that Plaintiff's claims against Governor Lamont and the Rocky Hill Chief of Police be dismissed with prejudice, but that Plaintiff's Fourth Amendment claim against Defendant Officer Smith proceed to service of process. The Court has also reviewed Plaintiff's objection to the Recommended Ruling. The Court first observes that Plaintiff reasserts her Fourth Amendment claim, perhaps in misapprehension of the fact that Judge Spector has recommended that the Fourth Amendment claim against Officer Smith go forward. To the extent that Plaintiff objects to dismissal of her claims against Governor Lamont premised upon his failure to enforce HB 6004, her objection does not address the basis upon which dismissal was recommended. And because the Recommended Ruling contains an accurate statement of the applicable law and a thoroughly reasoned analysis and application of that law to the circumstances presented here, the Recommended Ruling is Accepted, Adopted and So Ordered. Claims against Governor Lamont and the Rocky Hill Chief of Police are dismissed with prejudice. The Clerk of the Court is directed to terminate these defendants. The claims against Officer Smith shall proceed to service of process.
