ORDER REFERRING CASE for Mediation. The parties may choose who they wish to mediate this matter, in which case the expenses of the mediation are to be paid by the parties. If the parties prefer the Court to appoint a Magistrate Judge to conduct the mediation and thus avoid the expense of retaining a mediator, the parties should advise the Court on or before April 8, 2014. The parties shall provide to the mediator within five (5) days after the selection proposed alternative dates for the mediation to facilitate its scheduling. The parties are to notify the Court within five (5) days of the mediation whether a settlement was reached. On or before March 20, 2014, Plaintiff shall submit to Defendant a summary of the facts he alleges support his Fair Labor Standard Act's claim. On or before April 3, 2014, Defendant shall submit to Plaintiff a summary of facts showing Plaintiff did not and was not required to work overtime on the days and during the hours Plaintiff identified in his summary.
