December 2, 2019 Opinion or Order Filing 5 ORDER - On November 22, 2019, this court issued an order directing the defendants to allege facts regarding the plaintiff's citizenship in order to satisfy the requirements for diversity jurisdiction [Doc. No. #3 ]. The defendant LG Chem, LTD has filed a response to this order supplementing paragraph 8 of its notice of removal to allege that the plaintiff is both a citizen and resident of Oklahoma [Doc. No. #4 ]. The court finds that the requirements for diversity jurisdiction have been met. In reviewing the notice of removal, the court noticed that LG Chem, LTD attached the plaintiff's opposition to a motion to dismiss that was filed by the other defendant LG Chem America, Inc. in the state court proceedings [Doc.No. 1-2]. However, no motion to dismiss or order on the motion to dismiss was included with the removal documents. A review of the docket of the case in the State Court of Fulton County does not show any indication that this motion has been adjudicated at the state level. Accordingly, LG Chem, LTD is DIRECTED to supplement its notice of removal by no later than December 9, 2019, to include any pending motions and accompanying briefing. In the event that the motion to dismiss LG Chem America, Inc. has already been adjudicated, LG Chem, LTD is DIRECTED to file a copy of that order by December 9, 2019, instead.
