Filing 2 ORDER GRANTING #1 Application for Leave to Proceed in forma pauperis but her Complaint has failed an initial frivolity review because it does not plausibly state a claim upon which relief may be granted. Because Plaintiff filed her Complaint without the aid of counsel, however, the undersigned will offer her one additional opportunity to amend before recommending that the District Judge dismiss this action. To facilitate the filing of Plaintiff's Amended Complaint, the Court DIRECTS the Clerks Office to send Plaintiff a copy via first-class mail of the Complaint for a Civil Case or Pro Se 1 form (the Complaint Form), an electronic copy of which is available on the website for the United States Courts. Using the Complaint Form, Plaintiff is ORDERED to file an Amended Complaint within 30 DAYS of the entry of this Order. Plaintiff is ADVISED that her Amended Complaint will supersede her original Complaint, and that she therefore should assert in the Amended Complaint any and all claims she wishes to bring against Defendant(s). Plaintiff is FURTHER ADVISED that failure to file a timely Amended Complaint complying with these instructions shall result in a recommendation that the District Judge dismiss this civil action. Also, throughout the pendency of this action, Plaintiff SHALL keep the Clerk and Defendant(s) advised of her address and telephone number at all times. Failure to do so may result in dismissal of the case. The Clerk is DIRECTED to resubmit this action to the undersigned if Plaintiff fails to comply. Signed by Magistrate Judge Regina D Cannon on 12/18/2023. (kng) |
