Filing 53 ORDER granting in part and denying in part 42 Partial Motion to Dismiss. The Court directs the Clerk to terminate Defendants Maxwell, Black, Skinner, Turner, and John/Jane Doe as parties as well as all deadlines and motions pertaining to them. De fendants shall have fourteen days to file an answer to Mr. Gibbons' Amended Complaint. The parties shall submit a discovery plan within thirty days of this Order. The Court cautions Mr. Gibbons' counsel, John P. Batson, against using exce ssive footnotes to evade the 26-page limit for motions filed in this Court. See LR 7.1(a), SDGa. If he continues to use footnotes in this manner, his briefs will, at the Court's discretion, either be rejected as unacceptable for filing or dismissed with leave to be refiled in proper form. Should the course of this litigation bear out as Mr. Gibbons believes, he may renew such motion without prejudice at the appropriat e time. The Court directs directing defense counsel to explain or to reiterate to each of the defendants the implications of the common representation, the advantages and risks involved, and their right to seek the advice of independent counsel. De fense counsel shall file a notice that it has complied with its obligations pursuant to Georgia Rule of Professional Conduct 1.7 with the Court by Friday, November 28, 2014. If any client expresses a desire for separate counsel, defense counsel shall inform the Court in its notice, and then a reasonable period of time can be allowed for the acclamation of new counsel, if the substitution is made promptly.
