Filing 16 ORDER ADOPTING 10 Report and Recommendations of the Magistrate Judge, as supplemented herein, is adopted as the opinion of the Court. Plaintiff's 15 Motion to Amend the Complaint is GRANTED. The Court DISMISSES Plaintiff's claims for monetary damages against Defendants in their official capacities. The Court also DISMISSES WITHOUT PREJUDICE Plaintiff's Bivens claims for punitive and compensatory damages. Additionally, for the reasons stated above, the Court DIMISSES Plaintif f's Eighth Amendment claims, as well as his claims brought pursuant to the Federal Tort Claims Act.
