Filing 16 RESPONSE TO #15 Order to Show Cause filed by Stephanie M. Redding. (Attachments: #1 Certificate of Service)(jpa) |
Filing 15 ORDER - Plaintiff has not submitted written consent by defendant to the amendments or sought the Courts permission to amend her pleading again. However, given the lenient standard to do so at this stage of the litigation, the Court interprets plaintiffs response as a Motion to Amend. Accordingly, the Court GRANTS that Motion #13 , and DEEMS the Second Amended Complaint filed as of January 28, 2022. Because plaintiffs third revised pleading differs significantly from her earlier pleadings, the Court also DENIES AS MOOT Defendants Motion to Dismiss #8 with leave to refile. Finally, after considering plaintiffs filings and her residency in Maryland, the Court is concerned that the Northern District of Georgia is not the most convenient forum for the parties to litigate this matter. Accordingly, the Court DIRECTS the parties to show cause no later than February 14, 2022 why this case should not be transferred to the United States District Court for the District of Maryland. Signed by Magistrate Judge Walter E. Johnson on 1/31/22. (klb) |

Redding's Request for Extension of Time for Service of Summons #5 , seeking a thirty-day extension of time to perfect service upon defendant. Pursuant to Federal Rule of Civil Procedure 4(m), if the plaintiff shows good cause for failing to serve the defendant within 90 days after filing the complaint, the court must extend the time for service for an appropriate period.
