REPORT AND RECOMMENDATIONS of the Magistrate Judge that Defendants' 52 MOTION for Su mmary Judgment be GRANTED IN PART and DENIED IN PART. Defendants' Motion for Summary Judgment as to Defendants Brown and McLeod should be GRANTED, and all claims against those Defendants should be DISMISSED WITH PREJUDICE. Defendants' Motio n for Summary Judgment as to Defendants Kubacki and Hutcheson should be DENIED, and all claims against those Defendants should remain pending. Likewise, as to Defendants Kubacki and Hutcheson, Defendants' Motion for Summary Judgment based on qua lified immunity, de miminis physical injury under the PLRA, and claims for injunctive relief should be DENIED. Defendants' Motion for Summary Judgment as to claims based on vicarious or supervisory liability and claims for money damages against Defendants in their official capacities should be DENIED AS MOOT. Any party seeking to object to this Report and Recommendation is ORDERED to file specific written objections within fourteen (14) days of the date on which this Report and Recommendation is entered.
