Plaintiff is GRANTED leave to proceed against Chief of Police Rusty York in hi s official capacity on his Fourteenth Amendment claim the Fort Wayne Police Department has a custom and practice of making arrests without probable cause and using excessive force. All other claims are DISMISSED. Clerk DIRECTED to transmit the Summon ses and USM-285 forms for Defendants to the US Marshals Service along with a copy of this Order.
