OPINION AND ORDER: The Court DENIES the Plaintiff's request to decertify the class as to all class members to allow presentation of evidence of special damages. Instead, after the general damages findings, the Court will decertify the class as to the 32 members who timely submitted the Claim Form. Further, the Court DENIES the Defendant's request to instruct the jury to consider evidence that most of the class members later received credit for time served for the time they spent detained in the ACJ before a probable cause determination.
