OPINION AND ORDER GRANTING 19 MOTION for Partial Summary Judgment by Defendant Norfolk Southern Railway Company. Plaintiff's allegations contained in the First Amended Complaint that Norfolk failed to adequately train, educate, instruct, super vise, qualify, and test the engineer operating the locomotive, and failed to adequately train, instruct, and supervise the train crew are DISMISSED WITH PREJUDICE.
