OPINION AND ORDER: GRANTING 23 MOTION for Summary Judgment by Defendant United States of America and DENYING 27 Cross MOTION for Partial Summary Judgment by Plaintiffs. The Hamiltons' claims are dismissed without prejudice for lack of juri sdiction to the extent they seek a deduction for partnership losses attributable to H-Cubed Enterprises.
