| Filing 12 Rule 16 Preliminary Pretrial Conference held collectively in cases 1:19-cv-19, 1:19-cv-21, 1:19-cv-22, 1:19-cv-24, 1:19-cv-49, 1:19cv-84, 1:19-cv-87, 1:19-cv-95, 1:19-cv-99, 1:19-cv-101, 1:19-cv-102, 1:19-cv-108, and 1:19-cv-109 on 5/22/2019 before Magistrate Judge Susan Collins. Attys David Farnbauch, Dennis Brown, Robert Chaiken and Marcus Misinec appeared in person on behalf of Plas. AUSA Deborah Leonard appeared in person and AUSA Orest Szewciw appeared telephonically on behalf of Dft. The scope of discovery discussed. Parties agree to proceed with discovery on the issue of statute of limitations first and will need approximately 9 months. Parties agree no Rule 16(b) deadlines should be set at this time. Parties anticipate taking the depositions of all the Plas and Dr. Bradley Hammersley. Parties advise contact has not been made with Dr. Hammersley and are unaware if he has retained counsel. Court opens discovery on the issue of statute of limitations. Telephonic Status/Scheduling Conference set for 3/4/2020 at 10:00 am (EST) to set Rule 16(b) deadlines. Court to initiate call.
