June 12, 2020 Opinion or Order Filing 3 CLOSED TRANSFER. ORDER TRANSFERRING ACTION TO NORTHERN DISTRICT OF INDIANA - Kenneth S. Ferguson filed a petition for expungement of conviction that he previously filed in an Indiana state court. He seeks to expunge convictions from Grant County, Indiana, which is located in the Northern District of Indiana. Because the petition challenges a state court conviction, the Court construes it as a petition for writ of habeas corpus pursuant to 28 U.S.C. 2254. Venue is proper in our district if either the challenged conviction occurred in our district or the petitioner currently resides in our district. See 28 U.S.C. 2241(d). Neither is true in this case. The petitioner's conviction occurred in the Northern District of Indiana and the petitioner currently resides in the Northern District of Indiana. Venue is improper in the Southern District of Indiana. Therefore, this action is now TRANSFERRED to the United States District Court for the Northern District of Indiana, Fort Wayne Division. (Copy to Petitioner via U.S. mail) Signed by Judge James R. Sweeney II on 6/12/2020.(JDC) [Transferred from Indiana Southern on 6/15/2020.]
