OPINION AND ORDER granting in part and denying in part 23 Motion for Summary Judgment. The Court GRANTS summary judgment as to all of Brittons claims against the Defendants, and Vasquezs due process claim under 42 U.S.C. § 1983 against the Def endants.However, the Court DENIES the Motion for Summary Judgment as to: (1) Vasquezs First Amendment claim under 42 U.S.C. § 1983 against the Defendants and (2) Vasquezs state claim under Ind. Code § 36-8-10-11(c) against the Defendants.
