Filing 88 OPINION AND ORDER The Court GRANTS in part and DENIES in part Defendants Motion for Summary Judgment DE 58 , and DENIES Plaintiffs Motion for Partial Summary Judgment DE 61 . The Court ORDERS that Summary Judgment is awarded to Defendants on Count II and III of the Complaint and on Plaintiffs FMLA Interference claims in Count I. The Court further ORDERS that Count IV of Plaintiffs Complaint, for ERISA Interference, is hereby DISMISSED with prejudice. The only claim remaining before the Court i s Plaintiffs claim in Count I of her Complaint that she was terminated in retaliation for taking leave under the Family Medical Leave Act of 1993.The Court REAFFIRMS the final pretrial conference set for March 23, 2012, at 9:00 a.m., and the trial set for April 30, 2012.
