February 3, 2015 Opinion or Order Filing 65 OPINION AND ORDER: Buncichs motion for summary judgment [DE 42] is GRANTED, and Garcia and Pabeysmotion for summary judgment [DE 46] is GRANTED in part and DENIED in part. Summaryjudgment is GRANTED as to all claims against all remaining defendants EXCEPT for the§ 1983 claims against Garcia in his individual capacity for (1) malicious prosecution, in violationof the due process clause of the Fourteenth Amendment; and (2) making false statements insupport of an arrest warrant, in violation of the Fourth Amendment. Plaintiffs motion for partialsummary judgment [DE 49] is DENIED. Barksdales motion for leave to file an amendedaffidavit [DE 64] is GRANTED, and Buncichs motion to strike [DE 60] is DENIED as moot.
