May 1, 2015 Opinion or Order Filing 9 OPINION AND ORDER: GRANTS pla Breiner leave to proceed against Dr Timothy Barth, Dr Liaw and Nurse Practioner Kathryn Wallace in their individual capacities as set forth in order, GRANTS pla Breiner leave to proceed against Dr Timothy Barth, Dr Liaw and Nurse Practioner Kathryn Wallace for injunctive relief as set forth in order; DISMISSES all other claims without prejudice; DISMISSES co-dfts Klosowski, Whelan, Kearby, Vorrier, Sevier, Ransone, Vaisvilas, Hobbs, Bugher, Lemmon, Nally, Grace Coll ege, Inc, and Corizon Medical Services from the case; DIRECTS the clerk to send pla Breiner two blank prisoner complaint packets; DENIES the motion for preliminary injunction 3 ; DIRECTS clerk to transmit the summons and USM 285 forms for Barth, Lia w and Wallace to the USMS along with a copy of the complaint and this order to effect service of process by 6/8/2015; ORDERS Barth, Liaw and Wallace to response pursuant to FedRCivP and ND Ind LR 10-1(b) only to the claims for which the pla has been granted leave to proceed in this screening order; and ORDERS Barth, Liaw and Wallace to serve on pla Breiner and file under seal a statement by 6/30/2015 describing pla Breiner's medical condition and what treatment he is receiving along with co pies of his pertinent medical records. If pla Breiner is scheduled for future medical treatment, for security reasons, that information may be filed with the Clerk under seal without serving pla Breiner with a copy.
